1. Introduction
Welcome to GentleFieldCo ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at gentlefieldco.sbs (the "Service") operated by GentleFieldCo.
By engaging with our Service or booking a charter, you consent to these Terms. Should you object to any portion of these Terms, the Service should not be accessed by you.
2. Service Overview
GentleFieldCo offers top-tier yacht charter solutions, including, but not confined to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private parties
- Extended charter trips
We retain the authority to alter or terminate services at our discretion, taking into account availability and climatic conditions.
3. Booking and Reservations
3.1 Booking Process
To confirm a charter reservation, you are required to:
- Have at least 18 years of life experience
- Submit truthful and complete booking information
- Forward the requisite deposit as delineated in the booking verification
- Accept these Terms & Conditions
3.2 Confirmation
Booking affirmation is subject to the receipt of initial payment and our subsequent written confirmation. We possess the discretion to decline service to any entity.
3.3 Availability
Charter scheduling is contingent upon availability of the vessel and favorable weather conditions. We strive to accommodate your booking preferences as much as possible.
4. Payment Terms
4.1 Pricing
All service fees are presented in £ and incorporate all applicable taxes unless specified otherwise. Pricing is subject to change at our discretion without prior notification.
4.2 Payment Schedule
- Deposit: A payment of 50% of the overall charter fee is required at the time of reservation confirmation
- Balance: To be paid in full 48 hours prior to the departure of the charter
- Supplementary charges (if applicable): To be settled at the conclusion of the charter service
4.3 Payment Methods
Accepted methods of payment include credit cards, wire transfers, and certified checks. Payments are processed utilizing secure, encrypted gateways.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: Entire amount refunded minus processing fees
- Cancellation within 24-72 hours of departure: Eligible for a refund of 50% of the total cost
- Should cancellation occur less than 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
If our captain deems the weather conditions as unsafe, we will propose to either:
- Reschedule the charter to an alternative available date free of extra charges
- Issue a full refund if a reschedule is not feasible
5.3 Mechanical Issues
Should there be any mechanical issue with the designated vessel, efforts will be made to provide an equivalent replacement. If this is not possible, a complete refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All guests shall:
- Adhere to instructions given by the crew
- Wear compulsory safety gear as indicated by the crew
- Disclose any health conditions that may impact their safety
- Stay within designated areas aboard
6.2 Prohibited Items
Certain items are forbidden onboard including:
- Glassware
- Illegal substances
- Weapons of any kind
- Excessive non-alcoholic beverages (in quantities beyond reasonable personal consumption)
- Pets, unless they have been pre-approved
6.3 Conduct
Passengers are obliged to behave respectfully at all times. A charter may be terminated early without refund in cases where passenger conduct compromises safety or hampers others' enjoyment.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is limited to the charter expense paid. We shall not bear responsibility for:
- Personal harm arising due to passenger carelessness
- Theft or destruction of personal effects
- Secondary, consequential, or punitive damages
- Delays due to climatic circumstances or other elements outside our control
7.2 Insurance Coverage
We sustain comprehensive marine insurance policies for our fleet and operations. Participants are advised to secure their own travel and property insurance.
7.3 Assumption of Risk
Engaging in our provided yacht services means acknowledging the intrinsic risks of marine activities and accepting personal accountability for your safety and well-being.
8. Modifications and Itinerary Changes
We remain entitled to vary itineraries, paths, or timetables as necessitated by weather, safety concerns, or operational demands. We will aim to provide substitute experiences of similar value.
9. Force Majeure
Occurrences including but not limited to severe weather, natural disasters, legal stipulations, port shutdowns, or mechanical failures, which are beyond our control, will exempt us from liability for any service delays, cancellations, or alterations.
10. Privacy and Data Protection
The management of your personal information aligns with our Privacy Policy. Use of our Service signifies your authorization of the assemblage and application of your data as outlined in our Privacy Policy.
11. Intellectual Property
All content found on our Service platform, comprising text, graphics, icons, and imagery, is subject to copyright and trademark legal protections. Unauthorized reproduction, distribution, or derivative creation is not permitted without our explicit consent.
12. Governing Law
The laws in force within United Kingdom govern these Terms. Any disputes will be adjudicated in courts located in Southampton, United Kingdom.
13. Changes to Terms
Modification of these Terms remains our prerogative. Updated Terms will be publicized on our website marked with the revision date. Service utilization following any amendments implies acceptance of the new Terms.
